Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor a self-employed professional activity.)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day,

- on which you or a third party nominated by you, who is not the carrier, have taken possession of the goods, provided you have ordered one or more products in a standard order and these product(s) are delivered uniformly;

- on which you or a third party nominated by you, who is not the carrier, have taken possession of the last goods, in case you have ordered several goods as part of a standard order and these are delivered separately;

- on which you or a third party nominated by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, in case you have ordered a product which is delivered in several partial shipments or pieces;

To exercise your right of withdrawal, you must inform us (Diving Mask c/o IP-Management +20408, Ludwig-Erhard-Str. 18, 20459 Hamburg, Phone Number: +49 234 54501097, Email Address: support@diving-mask.com) by means of a clear declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient that you send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we are informed about your decision to withdraw from this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

We may withhold reimbursement until we have received the returned goods or until you have provided evidence that you have sent back the goods, whichever is earlier.

You shall send back or hand over the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate to us your withdrawal from this contract. The deadline is met if you send back the goods before the 14-day period has expired.

You will bear the direct cost of returning the products.

You only have to pay for any diminished value of the goods if this loss in value is due to handling that is not necessary for checking the condition, properties, and functionality of the goods.

Criteria for Exclusion or Expiry

The right of withdrawal does not exist for contracts

- for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
- for the delivery of goods that can spoil quickly or whose expiration date would quickly be exceeded;
- for the delivery of alcoholic beverages whose price was agreed at the time of the conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;

- for the delivery of newspapers, periodicals, or magazines, with the exception of subscription contracts. The right of withdrawal expires prematurely for contracts

- for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery;
- for the delivery of goods if they were inseparably mixed with other goods after delivery due to their nature;
- for the delivery of sound or video recordings or computer software in a sealed package if the seal was removed after delivery.
